What happens if you have lost capacity and can’t make a Lasting Power of Attorney?
Our court of protection team are here when your loved ones have lost capacity and can no longer create the above documents.
If someone has not created an LPA and no longer has capacity to do so, this does not mean that no one can make decisions on their behalf. An application can be made to the court of protection which will appoint a deputy, they have similar duties and responsibilities to an attorney.
