Not happy with my conveyancing solicitor – what can I do?

As buying or selling a house is the largest financial transaction most people ever undertake, it is crucial that you appoint a conveyancing solicitor who meets your requirements in all respects.

Sometimes, however, clients may consider changing solicitors during conveyancing. This could be because:

  • There has been a lack of communication
  • The conveyancing process is taking longer than expected
  • Costs are escalating
  • You have lost confidence in your solicitor
  • There is a lack of personal empathy between you
  • The transaction has become more complex and you need someone with broader legal expertise

Can you change your solicitor during the conveyancing process?

In situations such as those above, it is understandable for clients to ask: ‘Can I change solicitors halfway through a case?’

It’s possible to do this, but it’s important to be aware that there could be a significant downside in terms of cost, time and stress.

Before changing solicitors during conveyancing, it’s advisable to discuss your concerns with either your solicitor or a colleague at their firm to see if a solution can be found.

For example, if your solicitor agrees to provide more regular updates,  this could alleviate your concerns about the rate of progress and help to boost your confidence in them.

Should you still be unhappy with your solicitor, it could be worth considering changing to a different conveyancer at the same practice to make for a smoother transition.

How much does it cost to change solicitors?

There is often a cost implication when you move to a new firm of solicitors.

Your original conveyancer will likely expect payment for the work they have carried out so far and may refuse to release vital documentation (such as search results) until payment has been made. In a worst-case scenario, you may end up paying twice for certain services.

It’s also important to appreciate that a change of solicitors could lead to a delay as your new conveyancer familiarises themselves with your transaction – leading to even more anxiety for you.
