…the Homes (Fitness of Human Habitation) Act 2018 creates an implied term of the tenancy that the landlord must ensure that the property is fit for human habitation when let and that it remains fit for the duration of the tenancy.
Existing periodic secure, assured and introductory tenancies will also be subject to such a requirement from 20 March 2020.
When assessing whether a property is fit for human habitation, in addition to the matters already identified in s.10, 1985 Act, regard must also be had to the presence of any hazard as defined in the Housing Act 2004 (i.e. the hazards which form the Housing Health and Safety Rating System).
